Supplier Code of Conduct

This supplier code of conduct was established to strive for making a sustainable future with stakeholders such as customers, partners, local communities, and personnel and this is also based on our ethical awareness and company value about coexistence and co-prosperity. Therefore, in case of violating supplier code of conduct, causing a huge risk to society and economic system, Nexen tire may suspend its business with relevant suppliers or call for related responsibilities.


1. Compliance

  1. 1) Our supplier should comply with the laws and regulations of the region and country where the business belongs.
  2. 2) Our supplier should be responsible for complying with an agreement for fair business.
  3. 3) Nexen Tire conducts regular ESG assessment based on its information security policy after mutual agreement.
  4. 4) Our supplier should operate confidential and anonymous reporting channels and whistleblowers protection programs in order to prevent illegal and unethical activities of in-company or internal and external members of in-company and to take appropriate measures. Besides, the internal whistle-blowing process should be open to the employees so that anyone can participate.

2. Anti-corruption and Anti-bribery

  1. 1) Our supplier will comply with relevant laws, including the Nexen Tire Code of Ethics and the Monopoly Regulation and Fair Trade Act.
  2. 2) In performing contract, suppliers should not request improper solicitation neither directly nor indirectly to all concerned persons including Nexen Tire personnel and public officials. Also, our supplier shall not offer/promise bribes, unfair profits such as money, valuables or entertainment.
  3. 3) In performing contract, our supplier is obliged to report Nexen Tire Ethics office in case that Nexen Tire personnel request to improper solicitation or demanding to give bribes, unfair profits such as money, valuables or entertainment neither directly or indirectly.

3. Respecting and Protecting Human Rights

Both Nexen Tire and our suppliers should respect the human rights of personnel so that they can maintain dignity. In addition, we have to make the efforts in good faith to help the socially disadvantaged and minorities (disabled, female entrepreneurs, ethnic groups, etc.) participate in our society.

  1. 1) Our supplier should respect the human rights of all personnel and prohibit inhumane treatment.
    In addition, related procedures and disciplinary regulations should be prepared to eliminate inhumane treatment, notifying them of personnel.
    (※ inhumane treatment: Sexual harassment, sexual abuse, physical punishment, mental/physical pressure, verbal abuse, unreasonable restriction, etc.)
  2. 2) Our supplier should not employ a child under the age of 15 or a person less than the legal minimum age of employment, not exploiting them in any way.
  3. 3) Our supplier should comply with the working hours of the personnel, not requesting to work beyond labor law of where the place of business belongs.
  4. 4) Our supplier should provide personnel with salary above minimum wage standard and pays lips with salary/deduction details. In case of overtime, additional allowances must be paid in accordance with the labor regulations where the workplace belongs. In addition, our supplier should make efforts to ensure workers' human rights and maintain their livelihood by paying their social insurance premiums.
  5. 5) Our supplier should ensure that personnel are free to organize and participate in labor unions in accordance with labor laws and regulations where they are located, and their personnel can the right to do collective agreements and peaceful rallies/demonstrations, or rejecting them.
  6. 6) In overall employment practices (recruitment, payment and incentives, promotion, training act), our supplier should have no discrimination in regard to race, skin color, age, gender, sexual orientation, gender identity, ethnicity, disability, pregnancy, religion, political orientation, union affiliation, nationality, or marriage. and not requiring workers or job seekers to medical examinations that can be used as grounds for discrimination.

4. Health & Safety Management

  1. 1) Our supplier is obliged to comply with the health and safety regulations of the workplace or the country, managing them with their own policies. In addition, this policy standard should be guided in the local language that relevant personnel can understand.
  2. 2) Our supplier must prohibit the use, possession, distribution, and sales of illegal drugs at all locations.
  3. 3) Our supplier should appropriately protect personnel from chemical and physical hazards that may occur in the workplace, consistently managing facilities and risk factors.
    Besides, every personnel are adequately trained regarding safety education and hazardous substances
    handling. In addition, the workplace on noise, vibration, indoor air quality, etc. should be regularly measured
    and analyzed into the level of implication. Therefore, factors of potential risk must minimize through appropriate action and control. if necessary, our supplier should provide personnel with adequate protective equipment and safety education.
  4. 4) Our supplier should provide us with safety/handling information on hazardous substances
    (product information, safety and health data, use and exposure scenarios, etc.), which of information should
    be complied with the legal requirements of the place of business.
    In addition, our supplier should disclose information on the health, safety and environment of the product
    In a transparent manner. so that, the relevant information should be properly described as label,
    and it is attached to the front of product when it is delivered.
  5. 5) In the event of an accident at supplier's workplace, our supplier must take proper corrective action, and forming up preventive action plan after event. Also, if necessary, notify Nexen Tire of relevant issue immediately.
  6. 6) If our supplier is suspended, fined or found the guilty for violating health and safety regulations and laws, our supplier must notify Nexen Tire of relevant issue immediately.

5. Environmental Management & Greenhouse Gas (GHG) Management

  1. 1) Our supplier is obliged to comply with environmental regulations of the country of the workplace,
    and managing workplace and business with their own policies.
  2. 2) If our supplier is suspended, fined or found the guilty for violating environmental regulations and laws, our supplier must notify Nexen Tire of relevant issue immediately.
  3. 3) Our supplier should be able to identify, measure, and control exhaust gases, waste water,
    and waste generated during the operation of various facilities in the business.
    In particular, in order to prevent emission accident, emission of hazardous substances should be adequately controlled by the certain measures.
  4. 4) Our supplier is obliged to economically use natural resources (water, raw materials, etc.) and preserve them, in addition, our supplier should try their best on development and adoption of environmentally friendly products, processes and technologies. From sustainability perspectives, relevant policies should be implemented across value-chain, by establishing reduction goals for raw materials and energy usage, emissions, waste, noise, natural resources and hazardous materials.

6. Conflict of Interest

  1. 1) Our supplier must not provide the special benefit for Nexen Tire personnel, their families, and their neighbors of Nexen Tire.
  2. 2) Personnel of Nexen Tire must not make money loans, guarantees, or personnel requests that may interfere with the proper business with our supplier.
  3. 3) If a conflict of interest may be expected, our supplier shall report to the Nexen Tire Ethics Office.

7. Anti-competitiveness

Nexen Tire and our suppliers must adhere to the general principles of market competition, making trade in accordance with mutually agreed morality and trade practices.


8. Protecting Confidentiality, Personal Data and Intellectual Property

  1. 1) Our supplier should comply with the security of information related to their personnel, business partners, and customers' personal information, finance, and health. For those reason of that, our supplier shall establish and operate protection policies.
  2. 2) Our supplier may request and collect personal information from their personnel, customers, supplier's personnel only under a legal consent, and even when collecting information, our supplier must comply with relevant laws and regulations in its area.
  3. 3) Our supplier should establish and operate policies to comply with protecting intellectual property, trade secrets, trademarks and confidential information.

9. Conflict Mineral

Our every supplier should not use minerals mined from conflict areas, and submitting a certificate of origin in regular basis. If necessary, Nexen Tire can conduct an on-site audit of our supplier.

  1. (1) The disputed areas refer to 10 regions of the Democratic Republic of Congo, Sudan, Central African Republic, Congo, Angola, Zambia, Tanzania, Brundi, Rwanda and Uganda.
  2. (2) Regulated minerals (conflict minerals) refer to tin, tantalum, tungsten and gold mined in the above 10 regions.

10. Additional Requirements

  1. 1) Our supplier should guide and educate their personnel on supplier code of conduct.
  2. 2) Our supplier may report to Nexen Tire Ethics office if certain actions of Nexen Tire personnel violate or may violate supplier code of conduct.
  3. 3) Nexen Tire strictly protects information and inquiries from our supplier and ensures confidentiality.
